These Terms are an agreement between you and [[PLACEHOLDER: legal entity name]], [[PLACEHOLDER: registered address]] ("we"), for the WishBell mobile app and related services (the "App"). By installing or using the App you accept these Terms. If you do not agree, do not use the App. Our Privacy Policy explains how data is handled and forms part of these Terms.
1. Who can use the App
You must be at least 18, or have a parent or guardian who agrees to these Terms and supervises your use. The App is not directed to children under 13. You must have the legal capacity to enter into a contract.
2. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own personal, non-commercial use, under these Terms and the rules of the app store you got it from. Apple's standard Licensed Application End User Licence Agreement applies to iOS users in addition, and in case of conflict on Apple-specific matters Apple's terms prevail.
You must not: copy, modify, reverse engineer or decompile the App except as the law allows; remove notices; use the App to break the law or others' rights; interfere with our servers, bypass limits or security (including App Check and quotas); use bots or scripts against the AI gateway; resell the App or its AI output as a service; or use the App to harass, defame or deceive anyone.
3. Your account (optional)
The App works without an account. If you create one (Google, Apple or phone sign-in) you are responsible for keeping your login safe and for activity under it. You can delete your account at any time in Me > Settings > Privacy.
4. Your content and other people's data
You own what you put in the App (events, people, notes, photos, wishes). You give us only the limited permission needed to store it for you if you turn on backup, and to process it as described in the Privacy Policy when you use AI features.
You are responsible for your content. In particular, when you add information about other people you confirm that you are doing so for personal or household purposes and that you will not use the App to collect or share details about others in a way that breaks the law or their reasonable expectations. Do not add content that is unlawful, abusive or infringes anyone's rights.
5. AI features
- AI features are optional and use third-party models (currently Google Gemini and Anthropic Claude) through our gateway, as described in the Privacy Policy. You are asked for consent before first use and can withdraw it at any time.
- AI output can be wrong, incomplete or unsuitable. Wishes, gift ideas and parsed events are suggestions. Check them before you save or send them. We do not guarantee accuracy. Dates are calculated by the App's own date engine, but you must still confirm them.
- Fair-use limits and daily caps apply, and may change. Do not use AI features to produce content that is unlawful, hateful, sexually explicit, deceptive or harmful, or to impersonate another person.
- You are responsible for what you send to others using AI-written text.
6. Festival, tithi and calendar information
Festival dates and tithi, paksha and month are calculated using astronomical methods and published tables. Different regions, traditions, sunrise locations and panchang authorities may differ by a day. The information is for convenience and is not religious or ritual advice. For important ceremonies such as shraddh, barsi or puja, please confirm the date with your pandit or priest. Choose the correct regional setting (Purnimanta or Amanta) in Settings.
7. Reminders and reliability
Reminders depend on your phone: notification permission, exact-alarm permission, battery optimisation, auto-start settings and the operating system. Some phone brands stop background work. We provide a Reliability Centre and a test reminder to help, but we cannot guarantee that every reminder will be delivered on time. Do not rely on the App as the only means of remembering something critical (for example medical, legal or travel deadlines).
8. Purchases and WishBell Plus
- The App is free. WishBell Plus is optional and may be offered as a monthly or yearly subscription or a one-time lifetime purchase. Prices are shown in the App in your local currency before you buy [[PLACEHOLDER: confirm prices; draft plan is INR 49 per month, INR 399 per year, INR 799 lifetime]]. Taxes may apply.
- Payment is taken by Google Play or the Apple App Store, not by us. Purchases are managed with the help of RevenueCat.
- Subscriptions renew automatically for the same period and price unless you cancel at least 24 hours before the end of the current period (Apple) or before the renewal date (Google Play). Cancel in your store account settings; deleting the App does not cancel a subscription.
- Free trial: if a trial is offered it is shown in the App; you will be charged when it ends unless you cancel before.
- Refunds are handled by the store under its own policy; we cannot issue refunds for store purchases ourselves, but we will help with the request. Nothing here limits any refund right you have under law.
- Features, limits and prices may change; changes to price apply to a subscription after notice and per store rules. Lifetime means the lifetime of the Plus offering for that app version line, not your lifetime [[PLACEHOLDER: confirm wording of "lifetime" with legal]].
9. Third-party services
The App uses services such as Firebase, Google, Anthropic, RevenueCat, WhatsApp links and app stores. Their terms apply to your use of them. We are not responsible for third-party sites, apps or services opened from the App.
10. Intellectual property
The App, its design, code, festival data, templates and brand belong to us or our licensors. Bundled fonts and icons are used under their open licences (for example the SIL Open Font Licence for Baloo 2 and Mukta; MIT for Phosphor icons) and their licence texts are in the App's open-source notices screen. These Terms give you no ownership of anything of ours. If you send feedback, you let us use it without obligation to you.
11. Availability, updates and changes
We may update, add or remove features, or suspend the App, for maintenance, legal or security reasons. Some updates may be needed to keep using the App. We may change these Terms; if the change is material, we will tell you in the App before it applies. If you keep using the App after that, you accept the change; if not, stop using it and delete your account.
12. Termination
You may stop at any time by deleting the App and your account. We may suspend or end your access if you seriously or repeatedly break these Terms or the law, or abuse the AI gateway. Sections that by nature should survive (for example 4, 10, 13, 14, 15) survive termination.
13. Disclaimers
To the fullest extent the law allows, the App and AI features are provided "as is" and "as available", without warranties of any kind, including merchantability, fitness for a purpose, accuracy, and uninterrupted or error-free operation. Nothing excludes rights you cannot lawfully waive.
14. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential loss, loss of data, profit or opportunity, or loss arising from a missed or late reminder, a wrong or inappropriate AI suggestion, or a wrong festival or tithi date. Our total liability to you for any claim is limited to the greater of (a) the amount you paid us through the stores in the 12 months before the claim and (b) INR [[PLACEHOLDER: 1,000]]. This does not limit liability that cannot be limited by law, such as for fraud or death or personal injury caused by negligence (where applicable).
15. Governing law and disputes
These Terms are governed by the laws of India. Subject to any mandatory consumer rights where you live, the courts at [[PLACEHOLDER: city, state]], India have exclusive jurisdiction. 16. Apple-specific terms (iOS only)
Apple is not a party to these Terms and has no obligation to provide maintenance or support for the App. In case of failure to conform to a warranty, you may notify Apple for a refund of the purchase price, and Apple has no other warranty obligation. Apple is not responsible for claims relating to the App, including product liability, legal compliance and intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms for iOS use and may enforce them against you. You confirm you are not in a country under a US embargo or listed as a restricted party.
